Continued Public Hearing of
February 1, 2006


I.     CALL TO ORDER  Chairman Philip Lindquist opened the continued public                                        hearing at 8:00 p.m.

        At the continued public hearing for the proposed Ridgewood Elm Estates subdivision, the board met with Timothy Bennett and Thomas Roux of Bennett Engineering of Sagamore Beach on behalf of the applicant, Ridgewood Custom Homes, to discuss news plans with a revision date of January 25, 2006 that were not available for distribution to other town boards prior to the meeting or for review by either the Planning Board office or the town’s engineer.   

        Mr. Bennett told the Board that the revised plans address the concerns voiced by its engineer, Peter Palmieri of Merrill Associates, Inc. of Hanover at the last session. He said that a meeting had been held at Merrill’s office the previous week and the issues discussed then had also been incorporated into the revised plans.  Mr. Palmieri was also in attendance at the continued public hearing as were seven unidentified abutters.

        Mr. Bennett raised the issue of whether 175 feet of frontage on both streets of a corner lot would be required for the creation of this subdivision as the lot in front is a hammerhead lot previously approved through the Form A/ANR process.  Board members discussed the question but rendered no decision noting this was the first time they had encountered the situation.

        Abutters were concerned with the impact the subdivision would have on existing flooding conditions in the area. They also questioned the intermittent nature of an existing stream. Mr. Bennett said that neither the quantity nor velocity of runoff from the subdivision could increase in accordance with state regulations. One abutter questioned how drainage from the subdivision could be allowed to run into a pond on her property. Mr. Bennett explained for the residents how the proposed drainage system has been designed to operate.

        Mr. Palmieri said that he still had a number of concerns.  His main concern, he said, is with drainage. He said he also has concerns with the culvert under the roadway.  He indicated that the developer needed to redo the calculations to give a more accurate representation.  He said that State stream crossing standards also must be met.   Member Gerard LeBlanc said that he had concerns with the use of two, 12 inch pipes.  He said he favored the use of one larger pipe.

        In order to give other departments an opportunity to review the latest plans and to allow the developer and the Board’s engineer an opportunity to further discuss areas of concern. Board members determined that the hearing should be continued.  Mr. Bennett provided the Board with a signed form granting it until April 24, 2006 to make a decision and file a Certificate of Action with the Town Clerk’s office.
